agregando documentos en edición bilingüe, en español e inglés, para facilitar
el conocimiento a estudiosos de otros países de habla no española que han sido instruidos en sus respectivas instituciones
educativas para buscar la verdad y difundirla
de buena fe de acuerdo a su leal y saber entender y se interesen en
sumarse a esta cruzada contra el colonialismo encubierto en defensa de la
Historia, del Derecho Internacional y de las Naciones Unidas en su tesonera
lucha contra el colonialismo en cualesquiera de sus formas. Estas
transcripciones son a título ilustrativo y debe prevalecer el texto de la
fuente de las cuales fueron tomadas.

DECRETO
DEL GOBIERNO ARGENTINO, DEL 10 DE JUNIO DE 1829 CREANDO LA COMANDANCIA POLITICA
Y MILITAR DE LAS ISLAS MALVINAS E ISLAS ADYACENTES AL CABO DE HORNOS INCLUIDA
LA TIERRA DEL FUEGO, CON SEDE EN LA ISLA SOLEDAD DE MALVINAS.
“Cuando por la gloriosa
revolución de 25 de Mayo de 1810 se separaron estas provincias de la dominación
de la Metrópoli, la España tenía una posesión material de las Islas Malvinas, y
de todas las demás que rodean el Cabo de Hornos, inclusa la que se conoce bajo
la denominación de Tierra del Fuego; hallándose justificada aquella posesión
por el derecho de primer ocupante, por el consentimiento de las principales
potencias marítimas de Europa y por la adyacencia de estas islas al continente
que formaba el virreinato de Buenos Aires, de cuyo Gobierno dependían. Por esta
razón, habiendo entrado el Gobierno de la República en la sucesión de todos los
derechos que tenía sobre estas Provincias la antigua metrópoli, y de que
gozaban sus virreyes, ha seguido ejerciendo actos de dominio en dichas islas,
sus puertos y costas, a pesar que las circunstancias no han permitido hasta
ahora dar a aquella parte del territorio de la República la atención y cuidados
que su importancia exige; pero siendo necesario no demorar por más tiempo las
medidas que puedan poner a cubierto los derechos de la República, haciéndole al
mismo tiempo, gozar de las ventajas que puedan dar los productos de aquellas
islas, y asegurando la protección debida
a su población, el Gobierno ha acordado y decreta:
Art. 1°.- Las Islas Malvinas y las adyacentes al Cabo de
Hornos en el mar Atlántico, serán regidas por un Comandante Político y Militar,
nombrado inmediatamente por el Gobierno de la República.
Art. 2°.- La residencia del Comandante Político y Militar
será en la Isla de la Soledad, y en ella se establecerá una batería bajo
pabellón de la República.
Art. 3°.- El Comandante Político y Militar hará observar
por la población de dichas islas las leyes de la República y cuidará en sus
costas de la ejecución de los reglamentos sobre pesca de anfibios.
Art. 4°.- Comuníquese y
publíquese.

Decree of the Government of
Buenos Ayres
(Translation)
Buenos Ayres, 10th June, 1829
When by the glorious Revolution of the 25th
of May, 1810, these Provinces separated themselves from the Dominion of the
Mother Country, Spain hold the important Possession of the Islands of the
Malvinas, (Falkland Islands) and of all the others which approximate to Cape
Horn, including that known under the denomination of Tierra del Fuego; this
possession was justified by the right of being the first occupant, by the
consent of the principal Maritime Powers of Europe, and by the proximity of these Islands
to the Continent which formed the Viceroyalty of Buenos Ayres, unto which Government they
depended. For this reason, the Government of the Republic, having succeeded to
every right which the Mother Country previously exercised over these Provinces,
and which its Viceroys possessed, continued to exercise acts of Dominion in the
said Islands, its Ports, and Coasts, notwithstanding circumstances have
hitherto prevented this Republic from paying the attention to that part of the
Territory which, form its importance, it demands. Nevertheless, the necessity
of no longer delaying such precautionary measures as shall be necessary to
secure the rights of the Republic; and at the same time to possess the
advantages which the productions of the said Islands may yield, and to afford
to the Inhabitants that protection of which they stand in need, and to which
they are entitled; the Government has ordered and decreed, as follows.
Art. I. The Islands of the Malvinas and those adjacent
to Cape Horn in the Atlantic Ocean, shall be under the command of a Political
and Military Governor, to be named immediately by the Government of the
Republic.
II. The Political and Military Governor shall reside
in the Island de la Soledad, on which a Battery shall be erected under the Flag
of the Republic.
III. The Political and Military Governor shall cause
the Laws of the Republic to be observed by the Inhabitants of the said Islands,
and provide for the due performance of the Regulations respecting Seal Fishery
on the Coasts.
IV. Let this be made public.
